provides an important service to citizens by helping to insure that new construction and new businesses are in compliance with city zoning and development ordinances and that land within the city and its extra-territorial jurisdiction area is platted in accordance with the city's subdivision ordinances. Also, it is through this department that ordinances are updated periodically and assistance with zoning or other development questions is provided.

The Planning and Community Development pages of the City's website is designed to give general information regarding procedures for zoning, platting and replatting property, along with information on associated fees. Regulations in the zoning ordinance, subdivision regulations. and other development-related ordinance may be discussed in detail at the recommended pre-application meeting and must be satisfied before a plat, replat or zoning request may be approved. Copies of these ordinances may be obtained through this department.

Zoning regulates how land is used and protects the character of each district. Zoning protects property value and the overall quality of the community as a whole through controlling density of construction and intensity of land use, as well as through setting standards for landscaping, screening, building setbacks and height, and signage. Platting is the way in which property is divided, through laying out on paper or mapping each piece of land. A recorded plat indicated lots, building lines, easements and rights-of-way, flood areas, boundary markers, and other permanent attachments to land.

Submittal Deadlines

  • Development Assistance Committee (DAC) - Friday two weeks prior to Tuesday DAC meeting.
  • Planning and Zoning Commission - Wednesday prior to Tuesday meeting.
  • Joint Public Hearing - 25 days prior to the joint public hearing meeting.
  • Zoning Board of Adjustment - meetings held the first Monday of each month when they have business.


.Development Process

Generally the development process follows the brief descriptions listed below. The development process can be viewed in Flow Chart form.

Zoning Change:

The type of zoning that is on a piece of property determines what land uses can legally be placed on the property. For example: If a property is zoned Single Family, a retail business may not be placed on that property without rezoning it to the category that allows that use, such as General Retail or Commercial. Rezoning a property typically involves the following:

 

  1. Pre-application conference (recommended but optional).
  2. Review by staff Development Assistance Committee (DAC).
  3. DAC review comments to applicant within 10 working days.
    Fees, original tax certification, boundary survey (if required) and completed application submitted by applicant.
  4. Notification posted in the newspaper at least 15 days prior to the Public Hearing date. Property owners within 200 feet of the subject property are notified by mail and a sign is placed on the property.
  5. Joint Public Hearing (Planning & Zoning Commission (P&Z) and City Council) - Recommendation by P&Z to City Council.
  6. City Council meeting - first reading.
  7. City Council meeting - final reading/Mayor signs ordinance.
  8. Copy of signed ordinance amending zoning sent to applicant.

 

 

Burleson currently has 18 different districts that include agricultural, residential, commercial and industrial zoning. City Council makes the final decision regarding the rezoning request. Staff comments, neighbors’ comments, current and future land use plan, and the recommendation from the Planning and Zoning Commission are taken into account when reaching a decision on whether or not to grant the applicant’s request.

The zoning process usually takes about 8 to 10 weeks. A "Development Meeting Calendar" is available upon request from this department. Failure to meet the deadlines or incomplete submittals can significantly increase the amount of time required to complete the zoning change process

Platting:

Before property may be divided and sold and a builder may construct a structure on previously undeveloped land, the property must be platted. Platting involves the process described below and generally take 6 to 8 weeks each for the preliminary and final plat stages

  1. Pre-application conference (recommended/optional).
  2. Review of preliminary plat by staff Development Assistance Committee (DAC).
  3. Review comments to applicant within 10 working days.
  4. Fees, original tax certification, corrected plat and completed application submitted by applicant.
  5. Consideration by Planning & Zoning Commission.
  6. Consideration by City Council.
  7. Submittal of final plat for review by DAC. Process repeats as shown above through consideration by City Council.
  8. After City Council approval, applicant submits three mylars for Mayor’s signature and filing by the city at county courthouse.
  9. Certified copies sent to applicant when filed.

 

Replats:

Property that has been previously platted may have the property lines redrawn or amended through a replat. This process involves a public hearing and notification of property owners within 200 feet of the property and may be completed in about 8 to 10 weeks.

  1. Pre-application conference (recommended/optional).
  2. Review by staff DAC.
    Review comments to applicant within 10 working days.
  3. Fees, original tax certification, corrected plat and completed application submitted by applicant.
  4. For replats of single-family and two-family residential properties, notification posted in the newspaper at least 15 days prior to Public Hearing date. Property owners within 200 feet of the subject property are notified by mail.
  5. Joint Public Hearing (Planning & Zoning Commission (P&Z) and City Council) - Recommendation by P&Z to City Council.
  6. City Council meeting.
    If approved, Mayor signs replat.
  7. Mylars (three required) are filed at county courthouse by city staff and certified copy sent to applicant.

The following fee schedule has been adopted by the City Council and is based upon actual costs incurred by the city to process items presented for consideration. These fees are non-refundable (except as noted) and are generally not collected until after an initial review by the staff Development Assistance Committee (DAC).
