  4. RELEASE, WAIVER OF CLAIMS, & INDEMNIFICATION

  6. I, on behalf of myself and/or the individual(s) being registered, agree to allow the registrant to participate in activities operated, offered, conducted, and/or otherwise provided by Keep Burleson Beautiful (KBB) and the City of Burleson, including but not limited to clean-up events, beautification projects, volunteer opportunities, classes, programs, community service, special events, and any other related activities (collectively referred to as the “Activities”).

    I hereby authorize KBB, the City of Burleson, and their respective employees, volunteers, board members, program directors, and authorized agents to act as agents for the registrant in consenting to medical, emergency, surgical, and/or dental care, services, examinations, or treatments deemed necessary by licensed professionals arising out of or in connection with participation in the Activities.

    In consideration for participation in the Activities, I hereby release, discharge, hold harmless, and waive any and all claims I/we may have against Keep Burleson Beautiful, the City of Burleson, and their respective council members, officers, agents, representatives, employees, volunteers, board members, program directors, heirs, executors, administrators, and assigns (collectively referred to as the “Releasees”) for any and all liability, damages, injury (including death), property damage, costs, legal fees, or expenses, whether known or unknown, resulting from or connected in any way to participation in the Activities, including any claims arising from the negligent or intentional acts of any Releasee.

    This agreement shall not be construed as a waiver of governmental immunity or any other legal defenses available to the City of Burleson or Keep Burleson Beautiful, whether under Texas law or otherwise. Acceptance of this release is not to be interpreted as an admission of liability by any of the Releasees.

    I further agree to indemnify and defend the Releasees if I am not legally authorized to sign on behalf of the registrant or if the registrant attempts to rescind this release. If any part of this release is found to be invalid, the remainder shall remain in full force and effect.

    This release shall remain valid for the duration of the registrant’s participation in Keep Burleson Beautiful activities and shall survive the termination or conclusion of such participation.

    By signing below, I acknowledge that I have read, understand, and agree to the terms and conditions of this Liability Waiver & Release.

    The waiver and release granted by the participant hereunder is legally binding and shall be considered irrevocable. Participant agrees that the city may rely upon this agreement to the fullest extent permissible at law or in equity.
